Moseley, Jeffrey D.

Jeffrey D. Moseley is a 1986 graduate of Vanderbilt Law School. He became an Associate at Buerger, Moseley & Carson in 1987, partner in 1990 and senior partner in 2002 upon the retirement of founder Richard Buerger. Jeff’s practice is focused in the area of health care law. He represents hospitals throughout the United States in relation to medical staff issues, including peer review and credentialing, board and medical staff bylaws, operational issues, EMTALA and contract matters. His practice also extends to corporate and municipal law. His published works include Safe Harbor: Changing the Practitioner/Facility Paradigm in 1992, Nashville Medical News, 1992 and Safe Ventures Doctors Take Money Out of Equation, Modern Healthcare Magazine, 1993. Currently, Jeff is a member of the American, Tennessee, and Williamson County Bar Associations, including the American and Tennessee Bar Associations Health Law Sections. He is a member of the American Health Lawyers Association, as well as the Tennessee County Attorneys Association. He has taught seminars and classes in the health care field including: “Governmental Hospitals: What they Can and Can’t Do in Today’s Changing Health Care Environment”, and “Health Care Management and the Law”, Belmont University. In 2009 he presented “The Poliner Case: Implications for Hospitals and Medical Staff Members” for the American Health Lawyers Association. March 2011 he served as a presenter in an American Health Lawyer’s Association educational session entitled “The Hospital, the Board, and the Medical Staff: Who is the Client When Advising on Medical Staff Issues” and in June 2011 he taught at the Tennessee Association Medical Staff Services Annual Meeting on Joint Commission MS.01.0.1.01.

Lisa Carson is a 1991 honors graduate of Vanderbilt University School of Law where she was a member of the Moot Court Board, the Order of the Coif and was the recipient of the prestigious Founder’s Medal. She joined the firm as a clerk in 1988, became an associate in 1991 and became a partner in 1996. Lisa splits her practice between health care operations law and defense litigation. She represents providers in matters concerning peer review, EMTALA, hospital and medical staff bylaws, medical malpractice and credentialing of physicians. She handles a variety of litigation for municipal and other clients, including tort defense, constitutional claims, and employment litigation. As an employment litigator, she has provided legal defense for clients in race, sex, age and disability discrimination actions, harassment cases and retaliatory discharge matters. Community involvement is very important to Lisa. She serves on the Board of Trustees and Building Committee for her church, is an active member of Rotary and is a member of the Board of Directors of the Williamson County Boys and Girls Club and Williamson Animal Services, Inc.. Lisa mentored aspiring young lawyers by coaching the Franklin High School Mock Trial Team for over ten years. She has been an instructor of Business Law and an adjunct professor of Health Care Management at Belmont University, and presents educational seminars for hospital boards, health care providers and medical staff support personnel throughout the country. Lisa is presently a member of the Williamson County Bar Association, the Tennessee Bar Association, the American Bar Association litigation section and the Tennessee County Attorneys’ Association.

Robert R. Cook is a 2001 graduate of the Thomas M. Cooley Law School in Lansing, Michigan and a graduate of Eastern New Mexico University with a major in political science. Robert served honorably in the United States Air Force from 1991 to 1997 where he was stationed in the Middle East during Operation Desert Focus/Operation Southern Watch in 1996. In 2001 he moved to Nashville and became an associate at Baydoun & Reese where he worked in the areas of contract and business law. He became an associate at Buerger, Moseley & Carson in 2002 and became a partner in 2008. Robert currently represents Williamson County as the lead attorney on matters pertaining to contracts, highway issues, information management systems, state legislation, and government operations. He has represented the Tennessee County Services Association on telecommunication legislation and was chosen to serve on the Telecommunication Technologies Board. Robert's involvement in the community includes serving on the Vintage Affair Board and as a member of the Franklin Lions Club. Robert has been a member of the Tennessee County Attorneys Association Board of Directors since 2003 and has served as both Vice President and President for the association. Robert is also a member of the Williamson County Bar Association, the Tennessee Bar Association and the American Bar Association.

Kenneth J. Young is a life-long resident of Franklin. Ken obtained his undergraduate degree from the University of Mississippi and his law degree from Nashville School of Law. Ken concentrates his practice in governmental, business transactions, corporate formation and governance, industrial development bond financing and PILOT programs, and non-profit/tax-exempt entities. He is an active member of the Williamson County Foster Care Review Board (1999-present), served on the Board of Directors for the Williamson County Chapter of the American Red Cross (2003-2008), is a member of the American, Tennessee and Williamson County Bar Associations, and the Williamson County Chamber of Commerce. Ken also represents several Emergency Communications Districts in Tennessee and is a member of the Tennessee Emergency Numbering Association and National Emergency Numbering Association. In 2009 he received the Volunteer Spirit Award from Franklin Tomorrow. In his spare time he enjoys participating in triathlons and playing indoor and outdoor soccer. He lives in Franklin with his wife and two children.

W. Kyle Simonton is a 2007 graduate of Southern Illinois University School of Law where he was a member of the National Scholars Honor Society and was a student contributor and editor for the Journal of Legal Medicine and Legal Medicine Perspectives. His published works include Problems with the Accommodations Granted to the Disabled During the Administration of the MCAT: Individual State Interests Versus National Uniformity, 27 J. Legal Med. 305 (2006), and Daubert and the Standard of Care, Legal Medicine Perspectives, American College of Legal Medicine (May/June 2006). In addition, he has received the American College of Legal Medicine’s Letourneau Award for outstanding original commentary in legal medicine. Kyle became an associate with the firm in 2007 and focuses his practice in the area of health care operations law. He represents hospitals throughout the United States in matters concerning peer review, credentialing, HIPAA, EMTALA, Joint Commission accreditation, board and medical staff bylaws, Anti-Kickback Statute/Stark compliance and various contractual issues. He has presented educational seminars for hospital boards and medical staffs, and recently served as a presenter for an American Health Lawyer’s Association educational session entitled “The Hospital, the Board, and the Medical Staff: Who is the Client When Advising on Medical Staff Issues.” Kyle is currently a member of the American Bar Association, Health Law Section; the Tennessee Bar Association; the Williamson County Bar Association; the American Health Lawyers Association; the American College of Legal Medicine; and the American College of Healthcare Executives.

Lee Ann Thompson graduated with honors in 2006 from the University of Tennessee, obtaining her Bachelor of Science in Business Administration. Lee Ann received her law degree in 2009 from the Vanderbilt University School of Law, where she was an associate justice of the Moot Court Board and an editor of the Journal of Entertainment and Technology Law. Lee Ann became an associate with the firm in 2009 and is currently a member of the American Bar Association, the Tennessee Bar Association, and the Williamson County Bar Association. Lee Ann focuses her practice primarily in the area of litigation, defending clients in the areas of contract, tort, employment and Constitutional law.

J. Andrew (Drew) Hughes graduated magna cum laude from Rhodes College, where he was elected to Phi Beta Kappa. He received his law degree from Vanderbilt University Law School in 2009. While in law school, Drew served as executive articles editor for the Vanderbilt Journal of Transnational Law and was an associate problem editor for the Moot Court Board. Prior to joining the firm as an associate in 2010, Drew spent a year as law clerk to the Honorable Judge Daniel P. Jordan III of the U.S. District Court for the Southern District of Mississippi. Drew will practice primarily in the areas of civil litigation and health care operations law. He is a member of the American Bar Association, Tennessee Bar Association and American Health Lawyers Association as well as the Williamson County Bar Association.

Scott C. Gardner graduated in 2005 from Middle Tennessee State University, obtaining his Bachelor of Arts in Political Science. Scott became an associate at the firm in 2011 after spending two years as an associate at Kay, Griffin, Enkema & Colbert.
